Three days in and North Yorkshire Council could be set to hold it's first by-election.
A by-election is likely to be called for one of the Scarborough seats on the new North Yorkshire Council.
The seat in the Eastfield division has become vacant following the resignation today of Councillor Tony Randerson.
A by-election will be triggered if two electors from the North Yorkshire area request this.
It will then take place within 35 days of the requests. If no requests are received, the seat will remain vacant until the next ordinary elections to the council in 2027.
The election notice published by North Yorkshire Council says
NOTICE IS HEREBY GIVEN under Section 87 (2) of the Local Government Act 1972 that due to the resignation of Tony Randerson, a vacancy has arisen in the Office of Councillor for the said Division.
A by-election is only triggered by local government electors requesting a by-election to take place. This requires TWO local government electors within North Yorkshire area (not just from the division) giving notice in writing to the Returning Officer.
Once the requests from the electors are received, the polling day for the by-election must be set at the Returning Officer’s discretion within 35 working days of the date of receipt of the requests. There is no time limit for receipt of the requests, but, if requests are not received, the seat will remain vacant until the next ordinary elections in 2027.
All requests for a by-election regarding this casual vacancy must be sent to the Proper Officer, at the address below.

The new North Yorkshire Council came in to being on Saturday replacing the former county and borough councils.
It's members were elected last May. They served one year as councillors on the old County Council and will now serve 4 years as councillors on the new North Yorkshire Council.
Councillor Randerson resigned from both the council and the labour party on Monday over concerns about the party’s political direction and leadership.
