A compulsory purchase order could be used to bring a property in Flamborough back in to use.
East Riding Council's cabinet has approved the move after hearing the property has been empty for well over a decade.
Executive Director of Communities - Paul Bellotti - says there are over 15 hundred empty properties in the East Riding, but not many that have been empty this long.
The council's cabinet has approved using a compulsory purchase order to bring the property back into use, if the owner wont do so voluntarily.
Executive Director of Communities, Paul Bellotti, says it's an unusual step.
A report presented to the council's cabinet said:
"It is recognised that at a time when there is significant demand for housing, empty dwellings can represent a lost opportunity to secure a home for someone who is in need. The Council’s Private Sector Housing Team with its internal partners endeavours to work with the owners of empty homes to bring them back into residential use.
This is initially by giving advice and guidance, where this is not possible then the most appropriate enforcement action is taken including as a final resort, acquiring the property by making a Compulsory Purchase Order (CPO).
43 South Sea Avenue, Flamborough, YO15 1BW (“the Property”) is defined as a “long-term” empty home as it has been empty for over fifteen (15) years. During this period there have been several complaints from neighbours concerned about the unoccupied state of the property.
The owner of the Property has failed to engage with the Council despite numerous letters sent to encourage them to bring it back into occupation or sell the property."
Councillor Leo Hammond backed the use of the compulsory purchase order.
But Councillor Wilkinson expressed some reservations about using CPO's
The Council say that the property is
"a semi-detached bungalow located within a residential street comprising an entrance hall, bathroom, kitchen, reception rooms, and two bedrooms. The Property has been empty since 2008 and is defined as a “long-term” empty property under the Council's Empty Homes Policy. The Property is an area of housing need and has reached the stage where it is starting to have impact upon the amenity of the area and there have been seven (7) complaints about it being empty. The Property has category 1 and 2 hazards as defined in the Housing Act
2004."
The council say that they have sent eight letters to the owner but have not had a response. The report to the executive stated:
"The owner of the Property was identified in 2022, and between September 2022 and January 2023, six (6) letters were sent asking for the owner to contact the Council to confirm their intentions regarding bringing the Property back into use. After no response was received from the owner, a seventh letter was sent to advise that a warrant of entry for inspection and valuation
was being applied for to the Courts. Again, no response was received, and the Property was entered under a warrant by Council officers on 28th March 2023.A total of eight (8) letters have been sent to the owner of the Property by the council and no response has been received
The Property is identified for priority action in accordance with the Council’s Empty Homes Policy and has now reached the final stage of interventions before consideration of compulsory purchase."
