York Magistrates Court has granted a three-month partial closure order for a property on Regent Street in Scarborough to tackle anti-social behaviour while safeguarding the resident.
Another closure order has been granted in Scarborough following reports of anti-social behaviour, with authorities taking action at an address on Regent Street.
York Magistrates Court officially granted a partial closure order for the property on Monday the 13th of April.
According to officials, this specific closure order has been designed with a dual focus. Primarily, it aims to ensure the safeguarding of the current resident, who is legally allowed to continue living at the property. Secondly, the measure protects the wider local community, as the strict conditions of the order prevent other people from attending or gathering at the address.
During the legal proceedings, the court determined that making the closure order was a necessary intervention to prevent future serious nuisance, as well as to stop any similar behaviour or disorder from occurring in the neighbourhood.
Under the conditions laid out by the court, it is prohibited for anyone to remain on or enter the address at any time. However, specific exemptions have been made to allow the property to function safely.
Alongside the resident, anyone deemed to have a reasonable and lawful reason to attend the premises is permitted to enter. This includes utility service providers dealing with gas, electric, and water, as well as the landlord, their designated agents, and the emergency services.
The partial closure order will remain actively in force for a period of three months.
Authorities have issued a stark warning that it is a criminal offence to breach the terms of the order. Anyone found violating the restrictions could face severe penalties, which could lead to a fine, up to fifty-one weeks in prison, or both.
PC Nick Patrick from Scarborough’s Neighbourhood Policing Team said:
"We work in a multi-agency partnership which allows us to identify vulnerable areas within our communities. The behaviours by those attending this property demonstrate the requirement for us to act."
